PLEASE READ THESE TERMS CAREFULLY BEFORE USING AIRCREW24. BY USING THIS APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT USE THIS APPLICATION.

1. Agreement to Terms

By downloading, installing, accessing, or using AirCrew24 ("the App", "Application", "Service", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you must immediately discontinue use of the Service and delete the Application from all your devices.

These Terms constitute a legally binding agreement between you and AirCrew24. Your continued use of the Service following any modifications to these Terms constitutes acceptance of those modifications.

2. Description of Service

AirCrew24 is a personal digital record-keeping application that provides:

  • Digital flight hour recording and tracking
  • Pilot currency reference tools and informational alerts
  • Multi-device synchronization via Apple iCloud
  • Flight data export capabilities (PDF, CSV)
  • Roster import from select airline systems
  • Offline functionality with local data storage
  • Custom field creation for personalized tracking
  • Statistics and analytics for personal reference

CRITICAL NOTICE: AirCrew24 is a PERSONAL RECORD-KEEPING TOOL ONLY. It is NOT an official logbook, NOT a regulatory compliance system, and NOT a substitute for any official records required by any aviation authority, airline, or employer worldwide.

3. Eligibility

You must be at least 13 years old to use this Service. By using AirCrew24, you represent and warrant that you:

  • Are at least 13 years of age
  • Have the legal capacity to enter into these Terms
  • Are not prohibited from using the Service under any applicable laws
  • Understand that you bear sole responsibility for maintaining official aviation records as required by law
  • Acknowledge that you will not rely on this Application for any regulatory, legal, or operational purpose

4. User Accounts

4.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept full responsibility for all activities under your account
  • Immediately notify us of any unauthorized use
  • Never share your account credentials with any third party

4.2 Account Termination

We reserve the right to suspend or terminate accounts immediately and without notice that:

  • Violate these Terms of Service
  • Provide false or misleading information
  • Engage in fraudulent or illegal activities
  • Attempt to misuse or exploit the Service
  • Remain inactive for extended periods
  • Pose a risk to other users or the Service

Upon termination, your right to use the Service ceases immediately. We are not liable for any loss of data or access resulting from account termination.

5. Subscription and Payment

5.1 Subscription Plans

AirCrew24 offers subscription-based access:

  • Monthly Plan: Billed monthly at the current rate
  • Annual Plan: Billed annually at a discounted rate
  • Free Trial: May be offered at our sole discretion and may be withdrawn at any time

5.2 Payment Terms

  • All payments are processed exclusively through the Apple App Store
  • Prices are subject to change with reasonable notice
  • All prices are subject to applicable local taxes
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
  • No refunds are provided for partial subscription periods, unused time, or any reason whatsoever except as required by applicable law
  • We are not responsible for any payment processing errors by Apple or third parties

5.3 Cancellation

You may cancel your subscription at any time through your Apple App Store account settings. Cancellation takes effect at the end of the current billing period. No refunds or credits are provided for the remaining period after cancellation.

6. User Content and Conduct

6.1 Your Content

You retain ownership of all flight data, personal information, and content you input into AirCrew24 ("User Content"). By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

  • Store and backup your data on your behalf
  • Synchronize your data across your authorized devices
  • Process your data to provide Service features
  • Generate anonymized, aggregated statistics (containing no personally identifiable information)

6.2 Accuracy of Data

CRITICAL DISCLAIMER - READ CAREFULLY:

YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR:

  • The accuracy, completeness, and correctness of ALL flight data entered into the Application
  • Maintaining official pilot logbooks, duty records, and all documentation as required by ANY and ALL applicable aviation authorities, regulations, airlines, employers, or other entities worldwide
  • Full compliance with all applicable aviation regulations, including but not limited to EASA, FAA, UK CAA, GCAA, CASA, Transport Canada, and any other national or international aviation authority
  • Verifying that ALL currency calculations, flight time totals, duty time records, and any other data displayed by the Application meet regulatory requirements
  • Cross-checking all Application data against official records before any operational use
  • Understanding and complying with Flight Time Limitations (FTL) schemes applicable to your operations
  • Maintaining awareness of your own legal flight duty periods, rest requirements, and currency status independent of this Application
  • Ensuring all crew members, aircraft, airports, and other data are correctly recorded
  • Backing up your data regularly using methods independent of this Application

THE APPLICATION MAY CONTAIN ERRORS, BUGS, INACCURACIES, OR CALCULATION MISTAKES. YOU MUST NEVER RELY SOLELY ON THIS APPLICATION FOR ANY PURPOSE.

6.3 Prohibited Conduct

You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Submit false, misleading, or fraudulent flight information
  • Use the Application as your sole or official pilot logbook
  • Rely on the Application for any operational flight decisions
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Share account credentials with any other person
  • Use the Service to facilitate violation of any aviation regulations
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any systems or data
  • Use the Service in any manner that could damage, disable, or impair the Service
  • Introduce viruses, malware, or other harmful code
  • Scrape, harvest, or collect data from the Service
  • Use the Service for commercial purposes without authorization
  • Misrepresent your identity or affiliation

7. Roster Import Feature

7.1 Roster Import Disclaimer

IMPORTANT - THE ROSTER IMPORT FEATURE IS PROVIDED FOR CONVENIENCE ONLY.

BY USING THE ROSTER IMPORT FEATURE, YOU ACKNOWLEDGE AND AGREE THAT:

  • Imported roster data may be incomplete, inaccurate, outdated, or incorrect
  • Airline schedules, duties, and assignments change frequently and without notice
  • The Application may not reflect the most current version of your roster
  • Technical errors may occur during the import process resulting in missing or incorrect data
  • We have no control over the accuracy or availability of airline roster systems
  • We are not affiliated with, endorsed by, or connected to any airline or roster system provider
  • You MUST ALWAYS verify all imported duty times, report locations, flight details, and assignments against your airline's official sources
  • You MUST check your official roster through your airline's approved channels before any duty
  • We are NOT responsible for ANY errors, omissions, or discrepancies in imported data
  • We are NOT responsible for schedule changes, duty swaps, or updates not reflected in the Application
  • We are NOT responsible for any consequences arising from reliance on imported roster data

7.2 No Airline Affiliation

AirCrew24 is an independent application and is NOT affiliated with, endorsed by, sponsored by, or officially connected to any airline, crew management system, or roster provider. Any airline names, logos, or systems referenced are the property of their respective owners.

8. Intellectual Property

8.1 Our Property

The Service and its original content (excluding User Content), features, functionality, design, code, graphics, logos, and trademarks are owned by AirCrew24 and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable, non-sublicensable license to use the App for personal, non-commercial use strictly in accordance with these Terms. This license does not include the right to:

  • Modify, copy, or create derivative works
  • Reverse engineer or attempt to extract source code
  • Sell, rent, lease, or sublicense the Application
  • Use the Application for commercial purposes
  • Remove any proprietary notices or labels

9. Privacy and Data Protection

Your use of AirCrew24 is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy at https://www.aircrew24.com/privacy to understand our data practices.

10. Third-Party Services

AirCrew24 integrates with third-party services including but not limited to:

  • Apple iCloud: For data synchronization and storage
  • Firebase: For authentication and analytics services
  • Sign in with Apple: For authentication
  • Sign in with Google: For authentication
  • Airline roster systems: For roster import functionality

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, content, or availability of any third-party services. Third-party services may become unavailable, change, or be discontinued at any time without notice.

11. Disclaimers

11.1 General Service Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPLETENESS, OR AVAILABILITY.

WE DO NOT WARRANT THAT:

  • The Service will meet your requirements or expectations
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate, reliable, or correct
  • Any errors in the Service will be corrected
  • The Service will be compatible with your devices or software
  • The Service will be available at any particular time or location
  • Any defects or errors will be corrected

11.2 Aviation Disclaimer

CRITICAL AVIATION NOTICE - READ THIS SECTION CAREFULLY:

AIRCREW24 IS A PERSONAL DIGITAL RECORD-KEEPING TOOL ONLY. IT IS NOT:

  • An official pilot logbook recognized by any aviation authority
  • A regulatory compliance system or tool
  • A Flight Time Limitations (FTL) management system
  • A fatigue risk management system
  • A crew scheduling or rostering system
  • A substitute for official airline or employer records
  • A legal document or official record of any kind
  • A source of operational, legal, or regulatory advice
  • A safety-critical system or application

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  1. Official Records: You must maintain official pilot logbooks, duty records, training records, and all other documentation as required by your applicable aviation authority (including but not limited to EASA, FAA, UK CAA, GCAA, ICAO member states, and all other national authorities), your employer, your insurance provider, and any other applicable entity.
  2. Currency and Recency: All currency calculations, recency tracking, and expiry alerts provided by the Application are for INFORMATIONAL AND PERSONAL REFERENCE PURPOSES ONLY. You MUST independently verify your legal currency status, medical validity, rating currency, and all other requirements through official channels before exercising any privileges of your license or certificate.
  3. Flight Time Calculations: All flight time calculations, including but not limited to total time, PIC time, SIC time, multi-crew time, night time, instrument time, cross-country time, and any other time categories, may contain errors and must be independently verified.
  4. Day/Night Calculations: Automatic day/night time calculations are approximations based on algorithmic estimates and may not accurately reflect the regulatory definitions applicable to your jurisdiction or operation type.
  5. Regulatory Compliance: We make no representations that the Application complies with, or will help you comply with, any aviation regulations in any jurisdiction. Regulations vary by country, operation type, and license category, and change frequently.
  6. No Operational Reliance: You must NEVER make any operational decisions based solely on information provided by this Application, including but not limited to decisions regarding fitness for duty, legal currency, rest requirements, or duty limitations.

AIRCREW24 IS EXPRESSLY NOT LIABLE FOR:

  • Missed flights, standby duties, reserve calls, or any schedule-related issues
  • Flight Time Limitation (FTL) violations, exceedances, or infringements
  • Crew duty time violations or rest requirement breaches
  • Fatigue-related incidents or decisions
  • Incorrect day/night time calculations or categorizations
  • Incorrect multi-crew, multi-pilot, or augmented crew time allocations
  • Currency lapses, expired ratings, certificates, or medical certificates
  • Regulatory non-compliance of any kind in any jurisdiction
  • Any operational decisions made based on Application data
  • Discrepancies between Application records and official records
  • Failed license applications, renewals, or conversions
  • Errors in imported roster data or schedule information
  • Loss of flight time records or any other data
  • Incorrect aircraft categorization or type ratings
  • Errors in approach, landing, or takeoff counts
  • Any consequences arising from Application use or inability to use

11.3 Data Accuracy Disclaimer

WHILE WE STRIVE TO PROVIDE ACCURATE CALCULATIONS AND RELIABLE SERVICE, WE EXPRESSLY DISCLAIM ANY WARRANTY THAT:

  • Flight time calculations will be accurate in all scenarios
  • Currency tracking will be complete or correct
  • Statistics and totals will be error-free
  • Synchronization will be complete or timely
  • Exported documents will meet any specific requirements
  • The Application will function correctly on all devices
  • Data will never be lost, corrupted, or inaccessible

11.4 Export Format Disclaimer

PDF and CSV exports are provided for personal reference and convenience only. We make no warranty that export formats comply with the requirements of any aviation authority, airline, employer, or other entity. You are responsible for verifying that any exported documents meet applicable requirements before submission or use.

12. Limitation of Liability

12.1 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIRCREW24, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, ASSIGNS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, punitive, or exemplary damages
  • Loss of profits, revenue, business, savings, or anticipated savings
  • Loss of data, use, goodwill, or other intangible losses
  • Personal injury or property damage
  • Unauthorized access to or alteration of your data
  • Interruption or cessation of Service
  • Bugs, viruses, or other harmful code
  • Errors, inaccuracies, or omissions in content
  • Any matter beyond our reasonable control

12.2 Aviation-Specific Liability Exclusions

WITHOUT LIMITING THE GENERALITY OF THE ABOVE, WE ARE SPECIFICALLY NOT LIABLE FOR:

  • Any aviation incident, accident, occurrence, or safety event of any kind
  • Any injury, death, or property damage arising from aviation activities
  • Employment consequences including termination, suspension, demotion, disciplinary action, or any adverse employment action
  • License, certificate, authorization, or rating suspension, revocation, limitation, or denial
  • Failed checkrides, proficiency checks, line checks, operator proficiency checks, or any examination or evaluation
  • Insurance claims, coverage disputes, denials, or premium increases
  • Legal proceedings, investigations, enforcement actions, or penalties arising from flight operations
  • Fines, penalties, or sanctions imposed by any aviation authority or government entity
  • Criminal charges or civil litigation of any kind
  • Lost income, wages, per diem, or any other compensation
  • Career damage, reputation harm, or professional consequences
  • Missed training events, simulator sessions, or required courses
  • Visa, work permit, or immigration consequences
  • Medical certificate issues or aeromedical concerns
  • Union grievances, arbitrations, or disputes
  • Any other consequences arising from aviation activities or records

12.3 Maximum Liability

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE LESSER OF: (A) THE AMOUNTS ACTUALLY PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

12.4 Essential Purpose

THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12.5 Jurisdictional Limitations

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

13. Indemnification

13.1 Your Indemnification Obligations

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS AIRCREW24, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, ASSIGNS, LICENSORS, AND SERVICE PROVIDERS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, DEBTS, FINES, PENALTIES, AND EXPENSES (INCLUDING BUT NOT LIMITED TO REASONABLE ATTORNEYS' FEES, EXPERT FEES, AND COURT COSTS) ARISING FROM OR RELATED TO:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any rights of any third party
  • Your User Content or data
  • Your violation of any applicable laws, regulations, or rules
  • Your violation of any aviation regulations or requirements
  • Any claim that your use of the Service caused damage to a third party
  • Any regulatory investigation, enforcement action, or proceeding related to your aviation activities
  • Any employment dispute related to your flight records or data
  • Any false, inaccurate, or misleading information you provided
  • Your failure to maintain proper official records
  • Any reliance you placed on the Application

13.2 Procedure

We will provide you with prompt written notice of any claim subject to indemnification. We reserve the right, at our expense, to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

14. Modifications to Service

We reserve the right, at our sole discretion and without liability to you, to:

  • Modify, suspend, or discontinue any feature or aspect of the Service at any time
  • Change subscription prices with reasonable notice
  • Limit certain features to specific subscription tiers
  • Introduce new features, services, or functionality
  • Change system requirements or compatibility
  • Impose limits on certain features or restrict access
  • Terminate the Service entirely

We will endeavor to provide reasonable notice of material changes, but are not obligated to do so.

15. Governing Law and Jurisdiction

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law principles.

15.2 Jurisdiction

Any legal action, suit, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the courts located in Dubai, United Arab Emirates. You consent to the exclusive jurisdiction of and venue in such courts and waive any objection based on inconvenient forum.

15.3 Waiver of Jury Trial

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO A JURY TRIAL IN ANY PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.

16. Dispute Resolution

16.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at legal@aircrew24.com and attempt to resolve the dispute informally for at least thirty (30) days.

16.2 Mediation

If informal resolution fails, the parties agree to attempt to resolve the dispute through mediation administered by a mutually agreed mediator in Dubai, UAE.

16.3 Arbitration

If mediation fails, any dispute shall be finally resolved by binding arbitration under the rules of the Dubai International Arbitration Centre (DIAC). The arbitration shall be conducted in English in Dubai, UAE. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

16.4 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

16.5 Time Limitation

ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM AROSE, OR IT IS PERMANENTLY BARRED.

17. Changes to Terms

17.1 Right to Modify

We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. The "Last Updated" date at the top of these Terms indicates when the most recent changes were made.

17.2 Notification

We will notify users of material changes through:

  • In-app notifications
  • Email to registered users (if available)
  • Prominent notice on our website
  • Updated "Last Updated" date

17.3 Acceptance

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service immediately.

18. General Provisions

18.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18.2 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

18.3 Assignment

You may not assign, transfer, or sublicense your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

18.4 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us, constitute the entire agreement between you and AirCrew24 regarding the use of the Service and supersede all prior agreements, representations, and understandings.

18.5 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.

18.6 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version shall prevail.

18.7 Survival

The following sections shall survive termination of these Terms: Sections 6.2 (Accuracy of Data), 8 (Intellectual Property), 9 (Privacy), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), 15 (Governing Law), 16 (Dispute Resolution), and 18 (General Provisions).

18.8 No Third-Party Beneficiaries

Except as expressly provided herein, these Terms do not create any rights for any third parties.

18.9 Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, or infrastructure failures.

19. Apple-Specific Terms

If you access the Service through an Apple device, the following additional terms apply:

  • These Terms are between you and AirCrew24 only, not Apple Inc.
  • Apple has no obligation to provide any maintenance, support, or warranty services for the Application
  • Apple is not responsible for addressing any claims relating to the Application, including product liability claims, regulatory compliance, or intellectual property claims
  • Apple is not responsible for any third-party claims that the Application infringes their intellectual property rights
  • Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce these Terms against you
  • You must comply with all applicable third-party terms when using the Application
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties

BY USING AIRCREW24, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU FURTHER ACKNOWLEDGE THAT THESE TERMS TOGETHER WITH THE PRIVACY POLICY REPRESENT THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND AIRCREW24, AND THAT IT SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN YOU AND AIRCREW24 RELATING TO THE SUBJECT MATTER OF THESE TERMS.
